The SADC Lawyers’ Association call for Expression of Interest for a consultancy on the compilation of a SADC Reference Document on Natural Resource Governance The SADC Lawyers’ Association The SADC Lawyers’ Association (SADCLA) is the representative body of lawyers, law societies and bar association in the 15-member SADC region. The Mission of the SACLA is to uphold and defend the rule of law without fear or favour. The thrust of the SADCLA’s activities cover the Rule of Law, Democracy and Good Governance, Human Rights, International Relations and Organisational Development. Under the SADCLA’s Democracy and Governance programme focus area, the SADCLA will be implementing a natural resource governance project. Terms of Reference The SADCLA will commission a consultant to produce a SADC reference document on natural resource governance. The SADCLA understands Natural Resource Governance to mean the legislation, policies, regulations and actions pertaining to and influencing the management, use, development and regulation of natural resources. The objective of the reference document is to inform on potential advocacy and law reform activities in the area of natural resource governance. This reference document will include: 1. A comprehensive and comparative study of legislations, regulations and policies on natural resource governance in the SADC region viz SADC, East African Community (EAC), Economic Community of West African States (ECOWAS), AU and international legal frameworks to inform on potential advocacy and law reform activities in the future eg. Promoting socio-economic rights through litigation. a. Baseline survey of the existing legislations, regulations and policies on natural resource governance in the SADC Member States; b. Research on the regional and specific national examples of the legislations, regulations and policies on natural resources governance in the EAC and ECOWAS; and c. A comparative analysis and recommendations. The document should also cite the specific areas of concern, which have borne legal challenges and human rights abuses. Methodology The consultant(s) will be expected to undertake desk study and interviews administered electronically and/or telephonically. Preference will be given to applicants who are fluent in at least one of the three (3) official SADC languages and a good working knowledge of at least one of the other two (2) official languages. The Consultant(s) will work with the SADCLA Programmes Officer who will be responsible for providing technical and administrative support and who will be responsible for presenting their findings and conducting training on the same during a regional training workshop activity. The reference document will be printed and widely distributed to SADCLA stakeholders, partners and members. Report to: The consultants will report to the SADCLA Programmes Officer once a month to discuss the progress of the report. The Programmes Officer will be responsible for providing technical and administrative support to the consultants. Project period: The entire consultancy is expected to last up to 3 months up until the production of a final document. The reference document will be presented at a 5 day training clinic for legal professionals on natural resource governance.
